In 2021, The Infrastructure Investment and Jobs Act (IIJA) was signed into law, which included the Build America, Buy America (BABA) Act. BABA reinforces domestic procurement requirements for federally funded infrastructure projects. The law requires that iron, steel, manufactured products, and construction materials used in these projects be sourced and produced in the United States, with compliance standards varying by material category.
BABA covers four categories where the product or material must be produced in the United States, unless a waiver is in place.
Iron or steel products means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States (1).
Manufactured products are articles, supplies, or materials that have been (i) processed into a specific form and shape; or (ii) combined with other articles, materials, or supplies to create a product with different properties than the individual articles, materials, or supplies. BABA-compliant manufactured products are produced in the United States, and the cost of components of the manufactured product that are mined, produced, or manufactured in the United States exceeds 55 percent of the total cost of all components (1)
Construction materials are defined as articles, materials, or supplies that consist of only one of the following items: non‐ferrous metals, plastic and polymer‐based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables), glass (including optic glass), fiber optic cable (including drop cable), optical fiber, lumber, engineered wood, or drywall.
How is BABA different from Buy American Act (BAA)?
The Buy American Act is from 1933 and is applicable to Federal procurement contracts. It stipulates that products manufactured in the USA must be of ≥65% domestic components, increasing to 75% in 2029.
